FINRA's 2026 Overhaul of the Securities Arbitration System

Joseph Stone Capital summarizes the arbitration reforms FINRA has proposed this year and what remains under review.

GARDEN CITY, N.Y., October 23, 2026 -- Joseph Stone Capital, LLC, a full-service broker-dealer, today published a review of FINRA's 2026 effort to modernize its arbitration forum, the system that resolves most disputes between investors, brokerage firms and their registered representatives.

"Arbitration rules shape how disputes are resolved for investors and firms alike," the firm said. "These proposals are worth following closely, whichever side of a dispute you may be on."

What FINRA has done so far:

  1. A broad review. In Regulatory Notice 26-06, published March 2, 2026 as part of its FINRA Forward rule modernization initiative, FINRA asked for public comment on a wide range of arbitration topics, including forum selection, motions to dismiss, discovery, punitive damages, arbitrator qualifications and selection, and the publication of awards. Comments were due May 1, 2026.
  1. Board discussion. FINRA's Board of Governors discussed potential changes to the forum's fairness, efficiency and effectiveness at its June 2026 meeting, in response to the comments received.
  1. A pending rule change on arbitrator selection. On August 12, 2026, FINRA filed a proposal with the SEC (SR-FINRA-2026-017) that would give parties more say in who hears their case. When a panel cannot be filled from the parties' ranked lists, parties would receive a new list to strike and rank instead of a randomly appointed arbitrator. When an arbitrator must be replaced mid-case, a short list of pre-screened, available arbitrators would become the default. FINRA's filing notes that randomly appointed "extended list" arbitrators accounted for about 1 percent of appointments in cases filed and closed from 2020 to 2025. The SEC's comment period closed September 18, 2026, and the proposal awaits Commission action.
  1. Faster hearings for some investors. Rule amendments effective March 30, 2026 allow accelerated processing of arbitrations for parties who qualify based on their age or health condition.

"Much of the agenda in Notice 26-06 is still at the discussion stage," the firm said. "Investors and industry participants should watch for further FINRA filings, each of which goes through public comment before taking effect."
